Why Register a Trademark

Trademark registration provides exclusive rights to use your brand name or logo. It prevents others from using similar marks that could confuse customers. Registration creates an asset that can be licensed or sold.

An unregistered trademark offers limited protection. The ™ symbol indicates a trademark application, while ® can only be used after registration. Registration in India lasts 10 years and can be renewed indefinitely.

Application Process

Search for existing trademarks at ipindia.gov.in before applying. Fill Form TM-A with applicant details, mark representation, and class of goods/services. Multiple classes require separate applications.

After filing, the examiner reviews the application for objections. Respond to any Examination Report within the prescribed time. If no objections, the mark is published in the Trade Marks Journal.

Opposition and Registration

Any person can oppose the trademark within 4 months of publication. Both parties present evidence and arguments. If opposition fails, the trademark proceeds to registration.

The Registrar issues the registration certificate after completion. Registration is valid for 10 years from filing date. File Form TM-R for renewal before expiry.

Trademark Classes

India follows the Nice Classification with 45 classes. Class 35 covers advertising and business services. Class 42 covers technology services. Choose classes carefully based on your business activities.
